Kendal Car Hire Agreement
All vehicle rentals are governed by a comprehensive Rental Agreement, which you will receive upon booking confirmation or at the time of vehicle collection. This document outlines the terms, conditions, insurance coverage, fees, and your obligations related to the rental. In case of any discrepancies between these Terms and the Rental Agreement, the Rental Agreement will prevail.
Eligibility Criteria
Rental Vehicle Requirements
- To hire a vehicle from Kendal Car Hire, drivers must be a minimum of 21 years old, though age limits may differ based on the vehicle model. A valid, full driving licence relevant to the vehicle category is required, held for the duration specified in the Rental Agreement. Additionally, drivers must present valid identification and proof of current address, along with payment details and a security deposit. Any other conditions outlined in the Rental Agreement must also be met.
3. Reservations and Payments
- Reservations can be made via our website, by telephone, or in person at our Kendal office. A deposit may be necessary to confirm your booking. The remaining balance and a security deposit are generally due upon vehicle pickup. All prices are listed in British Pounds (£) and include VAT where applicable. We accept major credit and debit cards, processed securely through trusted payment providers.
Vehicle Pickup and Drop-off
- At the time of vehicle collection, a comprehensive inspection is required. Any pre-existing damage must be reported immediately. A vehicle condition report will be completed and signed by both parties. The vehicle should be returned in the same state as it was collected, taking into account standard wear and tear. Any new damage will be evaluated and charges may apply. It is important to return the vehicle with the same fuel level as when it was picked up; otherwise, refueling fees will be incurred. Late returns may result in additional charges, so please notify us as soon as possible if a delay is anticipated. You are liable for any parking tickets, traffic violations, or other charges incurred during the rental period, along with a processing fee.
Insurance and Liability Terms
- All rentals include basic third-party insurance. The Rental Agreement outlines full coverage details and applicable excess amounts. You may have the option to purchase additional insurance to lower your financial liability. It is advisable to review these options thoroughly. You remain liable for damage or loss up to the excess amount, except where additional insurance applies. Any damage resulting from negligence, misuse, or violation of these Terms will remain your responsibility, irrespective of insurance coverage.
Cancellation and Modifications
Cancellation and amendment policies differ based on the type of booking and the notice period provided. For precise information, please consult your booking confirmation or Rental Agreement. Be aware that late cancellations or failure to show may incur additional charges.
7. Restricted Activities
Prohibited Uses of Rental Vehicle
- Usage of the vehicle for any illegal activities is strictly prohibited. Engaging in racing, rallying, off-roading, or other risky behaviors is not allowed. Transporting hazardous materials or sub-letting the vehicle to unauthorized drivers is forbidden. Driving under the influence of alcohol or drugs, exceeding passenger or weight limits, and operating the vehicle outside agreed geographical boundaries without prior consent are also unacceptable practices.
Breach of these terms may lead to rental termination and fees.
Liability Limitations
To the fullest extent allowed by English and Welsh law, Kendal Car Hire will not be responsible for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business connected to your use of our services. Our overall liability for any claims is capped at the amount you paid for your rental in the previous 12 months. This limitation does not apply to liability for death or personal injury resulting from negligence, or for fraudulent activities.
9. Applicable Law
These Terms are regulated by the laws of England and Wales. Disputes will fall under the exclusive jurisdiction of the relevant courts in this region.
10. Updates to Terms
We can update these Terms at any time. Changes take effect immediately upon posting on our website. Continued use of our services indicates your acceptance of the revised Terms.
