1. Kendal Rental Agreement

All Kendal vehicle rentals are subject to a detailed Rental Agreement provided at booking confirmation or vehicle collection. The agreement outlines the specific terms and conditions, insurance cover, charges, and your responsibilities for the particular rental. If there's any conflict between these Terms and the Rental Agreement, the Rental Agreement will prevail.

2. Eligibility for Kendal

To rent a vehicle from Kendal, you must:

• Be at least 21 years old (age restrictions at Kendal may vary by vehicle type, with additional charges possible for drivers under 25). Hold a valid, full driving licence appropriate for the vehicle category, held for the minimum period specified in the Rental Agreement. Provide valid identification and proof of address and an accepted payment method.

3. Booking and Payment

• Bookings may be made through our website, by phone, or in person at our Kendal office. A booking deposit may be required to confirm your reservation. Full payment and a security deposit are typically due when the vehicle is collected. All prices are shown in British Pounds £ and include VAT where applicable.

4. Vehicle Pickup and Return

• When collecting a Kendal vehicle you must inspect it closely and report any pre-existing damage immediately. Kendal will prepare a vehicle condition report for signing at collection. Return the vehicle in the same condition as received, subject to normal wear and tear. Any new damage found on return will be evaluated and charged to the hirer.

5. Coverage and Liability

• Kendal includes basic third-party insurance with all rentals. Full coverage details and excess amounts are listed in the Rental Agreement. Additional insurance options may be available to reduce your financial liability. Please review these options carefully. You are responsible for damage or loss up to the stated excess amount.

6. Cancellation and Modifications

Kendal's cancellation and amendment policies vary by booking type and notice period. Consult your booking confirmation or Rental Agreement for specific terms. Late cancellations or no-shows may incur charges.

7. Kendal Prohibitions

You must not use Kendal's rented vehicle for:

• Use of Kendal vehicles for any illegal purpose or activity. Participation in racing, rallying, off-roading, or other hazardous activities. Transporting hazardous or dangerous materials, including flammable or explosive substances. Sub-letting to third parties or permitting unauthorized drivers. Operating the vehicle while impaired by alcohol or drugs. Any use that exceeds the vehicle’s intended design or manufacturer recommendations.

Breaching Kendal’s restrictions may result in immediate rental termination and additional charges.

8. Limitations on Liability

To the maximum extent permitted by English and Welsh law, Kendal will not be liable for indirect, incidental, special, or consequential damages, or loss of profits, data, or business, arising from your use of our services. Our total liability for any claim will not exceed the fees paid by you for the relevant services in the twelve months preceding the claim.

9. Applicable Law

Kendal's Terms are governed by the law of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Changes to Kendal Terms

Kendal may modify these Terms at any time. Modifications become effective immediately upon posting to Kendal's website. Your continued use of Kendal's services constitutes acceptance of the modified Terms.
